DISTANCE SALES AGREEMENT
1. Parties
This Distance Sales Agreement ("Agreement") is concluded electronically between the Seller, whose details are provided below, and the Buyer, who purchases products through the website.

2. Subject
The purpose of this Agreement is to define the rights and obligations of the Seller and the Buyer regarding the sale, delivery, payment terms, right of withdrawal, return, and exchange conditions of the products ordered electronically by the Buyer through www.desigualdad.design.
3. Product Information
The products covered by this Agreement consist of jewelry, accessories, and handmade designer products with the characteristics, quantity, descriptions, and sales prices displayed on the website.
The essential characteristics of the products, their sales prices, total price including applicable taxes, payment method, and delivery information are presented to the Buyer during the checkout process before the order is confirmed.
4. Payment
The Buyer shall pay the purchase price using one of the payment methods available on the website.
Payments are securely processed through authorized payment service providers and/or banking infrastructures. The Seller shall not be held directly liable for technical issues arising from payment service providers but will provide reasonable assistance to the Buyer where possible.
5. Delivery
Products shall be delivered to the shipping address provided by the Buyer during checkout.

Estimated international delivery: Approximately 10–15 business days
Delivery times may vary depending on production time, courier services, customs procedures, public holidays, and force majeure events.
For international orders, any customs duties, import taxes, VAT, brokerage fees, or other charges imposed by the destination country shall be the sole responsibility of the Buyer.
6. Handmade Product Notice
All Desigualdad Design products are handmade.
Therefore, slight variations in color, texture, gemstones, pearls, seashells, natural materials, dimensions, and overall appearance may occur.
These differences are a natural characteristic of handmade products and do not constitute defects.
7. Right of Withdrawal
The Buyer has the right to withdraw from this Agreement within 14 days from the date of receiving the product without providing any reason.
To exercise the right of withdrawal, the Buyer must notify the Seller in writing or through another durable medium within the 14-day period.

8. Return Conditions
To qualify for a return under the right of withdrawal, the product must:

Be unused;

Be undamaged;

Be returned in its original packaging together with the invoice and all accessories;

Be in a condition suitable for resale.
The Buyer shall return the product within the legally prescribed period after notifying the Seller.
Once the returned product has been received and inspected, and provided it complies with these conditions, the refund shall be processed within the legally required period using the same payment method originally used by the Buyer.
9. Products Excluded from the Right of Withdrawal
The right of withdrawal does not apply to:

Products made according to the Buyer's personal specifications or clearly personalized requests;

Custom-made products including personalized names, sizes, colors, designs, or special orders;

Products unsuitable for return due to hygiene reasons once their packaging has been opened;

Used, damaged, or products no longer suitable for resale.
10. Shipping and Return Shipping Costs
Shipping charges are clearly displayed during the checkout process.
Responsibility for return shipping costs shall be determined in accordance with applicable legislation and the return conditions communicated to the Buyer at the time of purchase.
If the product delivered is defective, damaged, or incorrect, the Seller shall bear the return shipping costs.
11. Defective or Incorrect Products
If the Buyer receives an incorrect, incomplete, damaged, or defective product, the Buyer should contact the Seller within a reasonable time after delivery.
The Seller will provide an appropriate solution, including replacement, repair, or refund, where applicable.
12. Rights and Obligations of the Parties
The Buyer declares that all information provided during the ordering process is accurate and complete.
The Seller undertakes to prepare the ordered products in accordance with the descriptions provided on the website and to dispatch them for delivery.
The Buyer is advised to inspect the package before accepting delivery. If the package appears damaged, the Buyer is encouraged to request that the courier prepare a damage report.
13. Force Majeure
Events beyond the Seller's reasonable control, including but not limited to natural disasters, war, pandemics, strikes, governmental actions, courier delays, customs procedures, technical failures, or similar unforeseen circumstances, shall be considered force majeure events.
In such cases, delivery times may be extended.
14. Dispute Resolution
Any disputes arising from this Agreement shall be resolved in accordance with the applicable consumer protection laws.
Where required by law, disputes shall fall under the jurisdiction of the competent Consumer Arbitration Committees and Consumer Courts.
15. Entry into Force
By placing an order through the website, the Buyer confirms that they have read, understood, and electronically accepted this Distance Sales Agreement.
